HomeAcquire (“HomeAcquire,” “we,” “us,” or “our”) provides housing market information, commentary, market summaries, and decision-support content for buyers, sellers, homeowners, and market watchers.

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

The Service is provided for general informational purposes only.

HomeAcquire does not provide legal, tax, accounting, appraisal, lending, investment, brokerage, or financial advice through the Service. Content made available through the Service is not a substitute for advice from qualified professionals familiar with your specific circumstances.

You are solely responsible for evaluating information and determining whether it is appropriate for your situation.

No Agency, Fiduciary, or Advisory Relationship

Your use of the Service does not create any broker-client, agent-client, fiduciary, advisory, attorney-client, or other professional relationship between you and HomeAcquire.

HomeAcquire does not represent you in any real estate transaction unless you and HomeAcquire enter into a separate written agreement that expressly states otherwise.

No Property-Specific Recommendation

HomeAcquire content is market-level or general informational commentary and is not a recommendation to buy, sell, hold, list, price, finance, refinance, or make an offer on any specific property.

Nothing on the Service should be interpreted as personalized advice or a recommendation regarding any particular transaction, listing, neighborhood, or property.

No Guarantee of Accuracy, Completeness, or Results

We strive to make the Service useful and timely, but we do not guarantee that any content is accurate, complete, current, reliable, available, or error-free.

Housing market information may come from third-party sources, may be delayed, incomplete, corrected, or revised, and may not reflect real-time local conditions. Market conditions can change quickly. Past or current trends do not guarantee future performance or outcomes.

Your reliance on the Service is at your own risk.

You are responsible for your own decisions and actions. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use.

No right, title, or interest in the Service or its content is transferred to you, except for the limited license expressly granted above.

Feedback

If you provide comments, suggestions, ideas, or other feedback about the Service, you grant HomeAcquire a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that feedback without compensation or obligation to you.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

HOMEACQUIRE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEACQUIRE AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR TRANSACTION-RELATED LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HOMEACQUIRE FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOMEACQUIRE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold harmless HomeAcquire and its affiliates, owners, officers, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the Service;
  • your violation of these Terms;
  • your violation of any law or the rights of any third party; or
  • content or information you submit through the Service.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you violated these Terms, created risk for us or others, or for any other lawful reason.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and governing law.

Changes to the Service

We may modify, suspend, discontinue, or remove any part of the Service at any time, with or without notice.

We are not liable for any modification, suspension, or discontinuation of the Service.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version and revise the “Last Updated” date above.

Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.

Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.

20.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

21.

Entire Agreement

These Terms constitute the entire agreement between you and HomeAcquire regarding the Service and supersede any prior or contemporaneous understandings regarding the Service.
